Terms of Use

Unofficial translation. If anything differs, the Spanish version prevails.
These terms govern the use of the nocturo.app website and the Nocturo app (the "Service"). By creating an account or using the Service you accept them. If you don't agree, don't use the Service.
1. Who provides the Service

2. The Service
Nocturo offers audio and text stories with interactive elements: case files based on real cases, and original fiction in the suspense, thriller and horror genres, along with a collection of cards and evidence that you unlock as you progress.
Real case files are narrative recreations based on public sources; they may include dramatizations and do not constitute journalistic or expert information. Fiction stories are original works, and any resemblance to real people is coincidental.
Some of the content deals with crime, violence and horror. The Service is not intended for anyone under 14.
3. Your account
- To use the app you need an account, which you create with Sign in with Apple or Google.
- You're responsible for what is done with your account and for keeping access to your Apple or Google account secure.
- You can delete your account at any time from the app, under Profile. Deleting it does not cancel an active subscription: that's done in the store (see section 4).
4. Subscriptions and purchases
- VIP Pass. A monthly or annual subscription that gives you access to the full catalog while it's active. The price and billing period are shown in the app before you pay.
- Single case purchase. A one-off payment that gives you access to that case for as long as the Service remains available, with no subscription needed.
- Apple (App Store) or Google (Google Play) charge you under their own terms. Subscriptions renew automatically at the end of each period unless you cancel them at least 24 hours in advance in your store account settings.
- Right of withdrawal. Because this is digital content delivered to you immediately, by purchasing you expressly accept that access starts at once and acknowledge that you lose the 14-day right of withdrawal (Art. 103.m of Royal Legislative Decree 1/2007). Refunds are handled under Apple's or Google's policies.
- You can restore your purchases from the app if you change device.
5. Acceptable use
By using the Service you agree not to:
- Copy, download outside the app, redistribute or sell the content.
- Access paid content without buying it, or circumvent any technical protection measures.
- Manipulate votes, collections or any other feature automatically or fraudulently.
- Interfere with the operation of the Service or attempt to access other users' data.
If you break these terms we may suspend or close your account. Except in serious or fraudulent cases, we'll warn you first and let you explain.
6. Intellectual property
Nocturo's stories, audio, illustrations, cards, trademarks and software belong to its owner or to its licensors. We grant you a personal, non-exclusive, non-transferable licence to enjoy them within the app and for private use. You acquire no other rights over them.
7. Availability and changes
We work to keep the Service running continuously, but there may be interruptions for maintenance or for reasons outside our control. The catalog may change over time. If we remove a case that you bought separately, we'll tell you with reasonable notice.
We may modify these terms. If the change is material, we'll let you know in the app or by email before it takes effect. If you don't agree, you can stop using the Service and delete your account.
8. Liability
We are liable for the damage we cause you by breaching these terms in the cases provided for by law. Nothing written here limits the rights granted to you by consumer and user protection rules.
9. Privacy
How we process your data is explained in the Privacy Policy.
10. Governing law and complaints
These terms are governed by Spanish law. If you are a consumer, you can bring claims before the courts of your place of residence. Before doing so, write to us at privacidad@nocturo.app and we'll try to sort it out.
